1. General Information

These Terms of Service govern access to and use of the Ticando platform ("the Platform"), owned by Ticando Technologies ("Ticando"), domiciled in Spain.

By accessing, registering with or using the Platform, the user ("the Client") accepts these Terms in full and without reservation.

These Terms govern two distinct relationships, and it is important not to confuse them. Most of this document governs the relationship between Ticando and the tour operator contracting the Platform. The Booking Terms section instead governs the sale of the activity to the traveller: that is the contract between the operator and the person booking, and Ticando is not a party to it.

2. Description of the Service

Ticando is a SaaS booking management platform for tour operators, offering the following services:

  • Online booking engine, embeddable as a widget.
  • Website creation (Basic Website or Web Portal) for marketing tourist experiences.
  • Control panel for managing availability, prices and bookings.
  • Additional artificial intelligence services (website chatbot, WhatsApp assistant).
  • Integration with third-party payment gateways.

3. Registration and Sign-up

To use Ticando's services, the Client must complete the registration process providing truthful and up-to-date information. The Client is responsible for keeping their access credentials confidential.

The sign-up process includes:

  • Completing the registration form with the company details.
  • Selecting the desired plan and additional services.
  • Accepting the Privacy Policy and these Terms of Service.
  • Payment of the deposit or sign-up fee corresponding to the selected plan, where applicable.
  • Registration with the payment gateway to receive booking payments.

4. Plans and Pricing

Ticando offers different service plans whose features and prices are detailed on the Pricing page. The prices shown exclude taxes, which are applied according to the tax legislation of the Client’s country.

Signing up to the Platform is free. Ticando charges a commission on each booking confirmed and processed through the Platform. The terms of that commission are agreed individually with each Client. Plans that include website creation (Basic Website or Portal) carry a separate one-off payment for that development, detailed on the Pricing page.

5. Client Obligations

The Client undertakes to:

  • Provide truthful and up-to-date information at all times.
  • Use the Platform in accordance with applicable law.
  • Not use the Platform for unlawful purposes or purposes contrary to these Terms.
  • Keep the information on their experiences and availability up to date.
  • Meet their tax obligations arising from the sales made.
  • Hold the licences and permits required to operate their tourism business.

6. Intellectual Property

All intellectual property rights in the Platform, including its source code, design, logos, trade marks and content, are the exclusive property of Ticando. The Client acquires no intellectual property rights through use of the Platform.

The Client retains ownership of the content they upload to the Platform (texts, images, experience descriptions), granting Ticando a non-exclusive licence to display that content on the Client’s website and on the Platform.

7. Payment Gateways

Integration with payment gateways is provided by third parties. Ticando facilitates the connection but is not responsible for the terms, fees or requirements of the payment gateways. The Client must register independently with the gateway of their choice and comply with its requirements.

8. Booking Terms

The following sections govern the sale of activities to the traveller: when a booking can be cancelled, what happens on a no-show, how refunds work and what applies in cases of force majeure. They apply to bookings made through the Platform unless the activity Provider publishes their own. Choose the variant matching the Provider’s country:

By completing your booking, you expressly accept the following terms, which apply unless the Provider's specific Terms state otherwise.

9. Who you are contracting with

The activity contract is entered into directly between you and the Provider operating it, whose identity and contact details appear in your confirmation email. Ticando acts as the technology platform facilitating the booking, and the payment gateway as the transaction processor. The Provider is responsible for delivering the activity.

10. Cancellations more than 48 hours in advance

Eligible for a refund, less a strictly non-refundable administrative and processing fee of USD 50.00. This fee is deducted automatically to cover internal labour and international bank reversal costs.

11. Cancellations between 48 and 24 hours in advance

Eligible for a refund of 50% of the total booking amount.

12. Cancellations less than 24 hours in advance

Strictly NON-REFUNDABLE. Cancellations requested within 24 hours of the activity's scheduled start time forfeit the full booking amount.

13. No-show policy

Strictly NON-REFUNDABLE. Failure to arrive at the designated meeting point exactly at the scheduled time is classified as a No-Show. No exceptions or partial refunds will be made for late arrivals.

14. Force majeure (unforeseen events)

The non-refund policies above apply strictly regardless of circumstances beyond your control. No refunds will be issued for medical emergencies, sudden illness, traffic, road closures, flight delays or bad weather, unless the activity is officially cancelled by the Provider. We strongly recommend purchasing travel insurance to cover these unforeseen events.

15. Cancellation by the Provider

If the Provider cancels the activity, you may choose between rescheduling at no cost or receiving a full refund of the amount paid.

16. How to cancel

All changes or cancellations must be requested directly from the activity Provider using the contact information shown in your confirmation email. The applicable tier is determined by the date and time the Provider receives the request.

17. Service Cancellation and Refunds

This section governs cancellation of the Ticando service. Cancellation of activity bookings is governed by the "Booking Terms" section above in this same document, which the Client may replace with their own terms.

The Client is responsible for ensuring that the terms applicable to their experiences are truthful, visible before payment is completed and compliant with the consumer legislation of their jurisdiction. Ticando acts as a technology platform and is not a party to the contract between the Client and the traveller.

As regards the Ticando service itself, the Client may cancel at any time. Sign-up fees paid are non-refundable once website construction or service activation has begun.

18. Limitation of Liability

Ticando shall not be liable for direct or indirect damages arising from:

  • Temporary service interruptions due to maintenance or force majeure.
  • Acts or omissions of third-party payment gateways.
  • Content published by Clients on their websites.
  • Disputes between the Client and their end customers regarding the experiences sold.

19. Data Protection

The processing of personal data is governed by our Privacy Policy, which the Client must read and accept as part of the registration process.

20. Amendments

Ticando reserves the right to amend these Terms of Service at any time. Amendments will be communicated to the Client at least 30 days in advance. Continued use of the Platform after notification implies acceptance of the new terms.

21. Governing Law and Jurisdiction

These Terms of Service are governed by Spanish law. For the resolution of any dispute, both parties submit to the courts of the city of Madrid, Spain, unless applicable legislation establishes a different venue.
